Legal agreement for using the HIMAN app

Please read these Terms and Conditions ("Terms") carefully before using the HIMAN app operated by AppSource ("we," "us," or "our"). Your access to and use of the HIMAN app is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the app.

By accessing or using the app, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the app.

1. Use of the HIMAN App

The HIMAN app is designed to provide users with a mobile application experience. You agree to use the app only for its intended purposes and in compliance with these Terms and all applicable laws and regulations.

2. Account Registration

Some features of the app may require you to register for an account. When you register, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. The app is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of AppSource.

5. Free and Paid Versions

The HIMAN app is available in both free and premium versions:

  • Free Version: Provides access to core features of the app at no cost.
  • Premium Version: Provides access to additional features, removal of advertisements, and priority support for a fee.

By purchasing the Premium version, you agree to pay all fees in accordance with the payment terms. All purchases are final and non-refundable except as specified in our Refund Policy or required by applicable law.

6. Prohibited Uses

You agree not to use the HIMAN app for any of the following:

  • In any way that violates any applicable national, federal, state, local, or international law or regulation.
  • To exploit, harm, or attempt to exploit or harm minors in any way.
  • To transmit or procure the sending of any advertising or promotional material, including spam or similar solicitations.
  • To impersonate or attempt to impersonate AppSource, an AppSource employee, another user, or any other person or entity.
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the app, or which may harm AppSource or users of the app or expose them to liability.
  • To attempt to circumvent any technological measure implemented by AppSource to protect the app or prevent or restrict access to any portion of the app.
  • To attempt to interfere with the proper working of the app.

7. Limitation of Liability

In no event shall AppSource, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the app;
  • Any conduct or content of any third party on the app;
  • Any content obtained from the app; and
  • Unauthorized access, use, or alteration of your transmissions or content.

8. Disclaimer

Your use of the app is at your sole risk. The app is provided on an "AS IS" and "AS AVAILABLE" basis. The app is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

9. Third-Party Links

The HIMAN app may contain links to third-party websites or services that are not owned or controlled by AppSource. AppSource has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that AppSource shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

10. Term and Termination

These Terms shall remain in full force and effect while you use the app. We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the app will immediately cease.

11. Privacy Policy

Please refer to our Privacy Policy for information on how we collect, use, and disclose information from our users. By using the HIMAN app, you acknowledge and agree that you have read and understand our Privacy Policy.

You agree to defend, indemnify, and hold harmless AppSource and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

  • Your use and access of the app;
  • Your violation of any term of these Terms;
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right; or
  • Any claim that your content caused damage to a third party.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15. Changes to Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Website thereafter. Your continued use of the Website following the posting of revised Terms means that you accept and agree to the changes.
